testing company fined for failing to identify carcinogens"},"content":{"rendered":"<h2>Airtec Filtration Ltd, a ventilation testing company was fined for failing to identify dangerous elements in the air, such as carcinogens and asthmagens<\/h2>\n<p>A St Helen\u2019s ventilation testing company was fined by HSE for providing its customers with inaccurate test results, leaving staff in those businesses unaware of potential risks they faced.<\/p>\n<p>Airtec Filtration Ltd was used by businesses across the UK to test extract ventilation systems, which reduce exposure to <a href=\"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/why-is-indoor-air-quality-in-buildings-important\/113778\/\" target=\"_blank\" rel=\"noopener noreferrer\">airborne contaminants in a workplace<\/a>.<\/p>\n<h3>Airtec were served with an Improvement Notice on 23 October 2019 after multiple site inspections found \u2018significant and common failings\u2019<\/h3>\n<p>Between 2018 and 2019, Airtec Filtration Ltd were providing Through Examination and Tests (TExT) of local exhaust ventilation (LEV) systems, which are designed to control substances dangerous to health.<\/p>\n<p>The company claimed their work met the requirements of the Control of Substances Hazardous to Health Regulations (COSHH) 2002.<\/p>\n<p>However, the testing reports provided to businesses were insufficient as hazardous substances were not adequately identified, and the <a href=\"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/natural-building-ventilation-importance\/107624\/\" target=\"_blank\" rel=\"noopener noreferrer\">local exhaust ventilation tests<\/a> were not carried out correctly.<\/p>\n<p>In one incident, when assessing a car manufacturing business, the Airtec engineer failed to identify the presence of rubber fumes, which are carcinogenic and can lead to cancer.<\/p>\n<p>In another, a baking company used flour and other respiratory allergens, which the engineer identified inadequately as food dusts.<\/p>\n<p>The Airtec engineer failed to provide any other information highlighting the presence of asthmagens, which <a href=\"https:\/\/www.pbctoday.co.uk\/news\/featured\/indoor-air-quality-iaq-2\/113164\/\" target=\"_blank\" rel=\"noopener noreferrer\">can lead to occupational asthma<\/a>.<\/p>\n<h3>Despite the Improvement Notice, Airtec did not provide sufficient training to their engineers<\/h3>\n<p>The Improvement Notice required Airtec to provide training to their engineers to ensure that they had adequate knowledge, training and expertise in the assessment, evaluation and control of risk arising from exposure to hazardous substances, so as to not expose persons who might be affected, to a potential health risk.<\/p>\n<p>An investigation by HSE found that Airtec was aware of the need for <a href=\"https:\/\/www.pbctoday.co.uk\/news\/featured\/bsria-indoor-air-quality-initiative-manage-iaq\/111849\/\" target=\"_blank\" rel=\"noopener noreferrer\">a competent person who held professional qualifications<\/a> to carry out the testing but did not provide the necessary training for their engineers.<\/p>\n<h3>Routine inspections of Airtec-inspected businesses raised further concerns about the service\u2019s accuracy<\/h3>\n<p>The issue came to light when HSE inspectors requested TExT reports relating to LEV systems from a number of businesses as part of routine inspections and investigations.<\/p>\n<p><a href=\"https:\/\/www.hse.gov.uk\/lev\/\" target=\"_blank\" rel=\"noopener noreferrer\">LEV is an engineering control system<\/a> installed to reduce exposures to airborne contaminants such as dust, mist, fume, vapour, or gas in a workplace.<\/p>\n<p>The documents received by inspectors raised concerns about the accuracy of Airtec Filtration Ltd\u2019s services who had tested the LEV systems for a number of businesses.<\/p>\n<p>HSE inspector Rose Leese-Weller commented in response to the ventilation testing company being fined: \u201cAirtec Filtration Ltd provided inadequate training to their engineers while claiming to provide a thorough testing service for LEV systems.<\/p>\n<p>\u201cThey provided businesses with unsatisfactory reports based on limited or inconclusive evidence, with little or no consideration of the level of risk of different hazardous substances.<\/p>\n<p>\u201cInhalation of hazardous substances at work can have devastating consequences to workers leading to occupational asthma, cancer, chemical asphyxiation or neuro-toxic effects.\u201d<\/p>\n<h3>The ventilation testing company being fined is a \u201c stark warning\u201d to the industry<\/h3>\n<p>Airtec Filtration Ltd, of Manor Street, St Helens pleaded guilty to contravening Section 3(1) of the Health and Safety at Work etc Act 1974. The company was fined \u00a32,666 and ordered to pay costs of \u00a34,074 at Manchester Magistrates\u2019 Court on 4 November 2022.<\/p>\n<p>Rose Leese-Weller concluded:<\/p>\n<p>\u201cThis company completely flouted regulations potentially putting hundreds of workers at serious risk.
