{"id":118903,"date":"2022-11-28T16:00:04","date_gmt":"2022-11-28T16:00:04","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=118903"},"modified":"2022-11-28T16:13:28","modified_gmt":"2022-11-28T16:13:28","slug":"demolition-director-and-firm-prosecuted-after-20-year-old-worker-crushed","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/demolition-director-and-firm-prosecuted-after-20-year-old-worker-crushed\/118903\/","title":{"rendered":"Demolition director and firm prosecuted after 20-year-old worker crushed"},"content":{"rendered":"<h2>Worker Shannon Brasier, who was 20 years old at the time of the accident, was crushed by a 21-tonne vehicle and suffered significant injuries<\/h2>\n<p>A demolition firm has been fined \u00a320,000, with one of its directors ordered to do 250 hours of unpaid work after a 20-year-old worker was crushed.<\/p>\n<p>Ace Demolition Services Ltd had been contracted by Southend Borough Council to demolish Futures Community College, in Southchurch Boulevard, Southend-on-Sea in 2020.<\/p>\n<p>Shannon Brasier of Dagenham, who was 20 years old at the time, was working with a colleague to load a fuel hose into the rear compartment of a 21-tonne excavator. Whilst doing so, the excavator moved round and crushed her between the excavator and a mobile fuel tank.<\/p>\n<p>Ms Brasier, from Dagenham, suffered life-changing injuries, including to her neck, skull and face, which she was fortunate to survive.<\/p>\n<h3>A lack of adequate training and site separation were to blame, the HSE found<\/h3>\n<p>An investigation by the Health and Safety Executive (HSE) found that the organisation <a href=\"https:\/\/www.pbctoday.co.uk\/news\/guides-reviews\/digitising-health-and-safety-in-the-construction-industry\/105360\/\" target=\"_blank\" rel=\"noopener noreferrer\">failed to implement suitable controls<\/a> to segregate pedestrians and construction plant, allowed two pairs of keys to be used during the refuelling process and allowed operatives to act as signallers\/banksman for the excavator <a href=\"https:\/\/www.pbctoday.co.uk\/news\/featured\/safety-culture-in-construction-burns-and-mcdonnell\/110357\/\" target=\"_blank\" rel=\"noopener noreferrer\">without having received adequate training<\/a>.<\/p>\n<p>A director, John Gilligan, was responsible for supervising the refuelling and drove the excavator before the refuelling was complete.<\/p>\n<p>Ace Demolition Services Ltd and John Gilligan, of Fox Burrows Lane, Writtle, Chelmsford pleaded guilty to breaching Section 2(1) and 37(1) of the Health &amp; Safety at Work Act 1974.<\/p>\n<p>Ace Demolition Services Ltd was fined \u00a320,000 and ordered to pay costs of \u00a39,731 at Chelmsford Magistrates\u2019 Court on 24 November 2022. John Gilligan was given a 12-month community order with a requirement to undertake 250 hours of unpaid work.<\/p>\n<h3>HSE said the incident could have easily been avoided<\/h3>\n<p>HSE inspector David Tonge said: \u201cThis incident could have so easily been avoided.
