{"id":119520,"date":"2022-12-20T08:08:46","date_gmt":"2022-12-20T08:08:46","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=119520"},"modified":"2022-12-19T15:55:22","modified_gmt":"2022-12-19T15:55:22","slug":"company-fined-100000-after-worker-crushed-to-death-on-site","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/company-fined-100000-after-worker-crushed-to-death-on-site\/119520\/","title":{"rendered":"Company fined \u00a3100,000 after worker crushed to death on site"},"content":{"rendered":"<header class=\"entry-header\">\n<h2 class=\"entry-title\">Thorndyke Developments was fined \u00a3100,000 and a site director was given a suspended prison sentence after a worker was crushed to death on site<\/h2>\n<div class=\"entry-meta\">A property development company has been fined \u00a3100,000, and a building firm director handed a suspended prison sentence after a labourer was fatally crushed while demolishing a wall.<\/div>\n<div><\/div>\n<div class=\"entry-meta\">41-year-old Jakub Fischer, a self-employed labourer originally from the Czech Republic, was hired as a sub-contractor by North West Facilities Limited to work on a house refurbishment project for Thorndyke Developments Limited.<\/div>\n<div><\/div>\n<div class=\"entry-meta\">Jakub was tasked with demolishing a rear yard wall dividing the property on Mansell Road, Liverpool, from the neighbouring house on 5 June 2019.<\/div>\n<div><\/div>\n<div class=\"entry-meta\">That day, other workers on the job left the site at 3.30pm however, when a neighbour returned home from work at around 5.40pm they saw Jakub trapped between an outer kitchen wall and a collapsed section of the yard wall. He was pronounced dead at the scene by emergency services.<\/div>\n<\/header>\n<div class=\"entry-content\">\n<h3>None of the necessary precautions were taken by management<\/h3>\n<p>An investigation by the Health and Safety Executive (HSE) found the demolition work was <a href=\"https:\/\/www.pbctoday.co.uk\/news\/guides-reviews\/digitising-health-and-safety-in-the-construction-industry\/105360\/\" target=\"_blank\" rel=\"noopener noreferrer\">not planned nor accounted for in the construction phase plan<\/a>, which could have prevented Jakub&#8217;s death.<\/p>\n<p>No <a href=\"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/health-and-safety-tips\/103194\/\" target=\"_blank\" rel=\"noopener noreferrer\">risk assessment or method statement<\/a> was provided and Jakub was not trained to carry out safe demolitions.<\/p>\n<p>There was also a lack of supervision as the system of work implemented by Thorndyke Developments Limited and North West Facilities Limited prohibited non-English-speaking workers from carrying out demolitions.<\/p>\n<h3>Those responsible for a site must ensure safe practices are carried out<\/h3>\n<p>David Peter Hartley, a director at North West Facilities Limited, pleaded guilty to breaching Regulation 13(1) of The Construction (Design and Management) Regulations 2015, by virtue of 37(1) of the Act. Mr Hartley, of Trearddur Road, Holyhead, Anglesey was given 26 weeks imprisonment, suspended for two years, and ordered to pay \u00a35,836 in costs at Wirral Magistrates\u2019 Court on 15 December 2022.<\/p>\n<p>Thorndyke Developments Limited, of Rodney Street, Liverpool pleaded guilty to breaching Regulation 4(1) of The Construction (Design and Management) Regulations 2015.
