As the final version of the regulations have only been published today and the Health and Safety Executive (HSE) only issued the draft Guidances for CDM2015 on 9<sup>th<\/sup> January 2015; the question must be asked of all construction industry organisations, and the industry itself, are we ready?<\/p>\n<p>The regulations can be viewed and downloaded from: <span style=\"color: #0000ff;\"><a href=\"http:\/\/www.legislation.gov.uk\/uksi\/2015\/51\/pdfs\/uksi_20150051_en.pdf\"><span style=\"color: #0000ff;\">http:\/\/www.legislation.gov.uk\/uksi\/2015\/51\/pdfs\/uksi_20150051_en.pdf<\/span><\/a><\/span>.<\/p>\n<p>On Friday, 9th January 2015, the HSE issued the draft text of L153 (draft), Guidance on the Construction (Design and Management) Regulations 2015, including the draft regulations, which can be downloaded from:<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.hse.gov.uk\/pubns\/priced\/draft-l153.pdf\"><span style=\"color: #0000ff;\">www.hse.gov.uk\/pubns\/priced\/draft-l153.pdf<\/span><\/a><\/span>.<\/p>\n<p>On the same date, the guidances produced for the five duty holders under CDM, plus the workers, were published in draft. The guidances set out, in practical terms, what actions are required of them to deliver a safe and healthy construction project.\u00a0 These documents have been written by the Construction Industry Advisory Committee (CONIAC). These six \u2018Industry Guidances\u2019 are available for free download, as follows:<\/p>\n<p>CDM15\/1 Industry guidance for Clients<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-clients.pdf\"><span style=\"color: #0000ff;\">www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-clients.pdf<\/span><\/a><\/span><\/p>\n<p>CDM15\/2 Industry guidance for Principal Designers<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-principal-designer.pdf\"><span style=\"color: #0000ff;\">www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-principal-designer.pdf<\/span><\/a><\/span><\/p>\n<p>CDM15\/3 Industry guidance for Contractors<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-contractors.pdf\"><span style=\"color: #0000ff;\">www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-contractors.pdf<\/span><\/a><\/span><\/p>\n<p>CDM15\/4 Industry guidance for Designers<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-designers.pdf\"><span style=\"color: #0000ff;\">www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-designers.pdf<\/span><\/a><\/span><\/p>\n<p>CDM15\/5 Industry guidance for Principal Contractors<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-principal-contractors.pdf\"><span style=\"color: #0000ff;\">www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-principal-contractors.pdf<\/span><\/a><\/span><\/p>\n<p>CDM15\/6 Industry guidance for Workers<\/p>\n<p><span style=\"color: #0000ff;\"><a href=\"http:\/\/www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-workers.pdf\"><span style=\"color: #0000ff;\">www.citb.co.uk\/documents\/cdm%20regs\/industry-guidance-workers.pdf<\/span><\/a><\/span><\/p>\n<h3>Policies and Procedures<\/h3>\n<ul style=\"list-style-type: circle;\">\n<li>CDM2015 will require all CDM duty holders to amend their policies and procedures to some extent.<\/li>\n<li>Clients will need to develop their arrangements for the enhanced client duties on significantly more projects.<\/li>\n<li>Those who would act as the Principal Designer (PD) will need to develop their procedures to perform these duties for all elements of design and planning, not just their design or their sub-consultants\u2019\/sub-contractors\u2019 design, but for all design, including temporary works design performed during construction.<\/li>\n<li>Principal Contractors and Contractors will need to address the requirement for having a Construction Phase Plan on all works, and the Domestic Client duties if they work in the domestic client sector.<\/li>\n<li>Designers have the least amendments to make, as their duties have minimal changes, unless they take on the Principal Designer\u2019s duties.<\/li>\n<\/ul>\n<h3>Training<\/h3>\n<p>Additional training will be required to update all of the duty holders with the amended regulations and guidances.<\/p>\n<p>The CDM2015 Training Courses that we are currently preparing, and will be in a position to present from February 2015 are as follows:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>CDM2015 Senior Management Briefing<\/li>\n<li>CDM2015 Overview<\/li>\n<li>CDM2015 Client<\/li>\n<li>CDM2015 Design Phase Risk Management Co-ordination<\/li>\n<li>CDM2015 Design Risk Management<\/li>\n<li>CDM2015 Reducing Risk by Design<\/li>\n<li>CDM2015 Principal Contractor and Contractors<\/li>\n<\/ul>\n<p>Summaries of the aims and objectives of these courses are shown below:<\/p>\n<h3>CDM2015 Senior Management Briefing<\/h3>\n<p>This 3.5 hours course is designed to provide senior management of client, project manager, principal designers, designer, principal contractor and contractor organisations with an understanding of the requirements of the CDM Regulations 2015.<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>appreciate the need, application and framework of the CDM regulations; and<\/li>\n<li>understand the duties and responsibilities of the client, principal designer, designers, principal contractor and contractors.<\/li>\n<\/ul>\n<h3>CDM2015 Overview<\/h3>\n<p>This 1 day course is designed to provide all persons involved in construction projects, including current and potential clients, project managers, principal designers, designers, principal contractors and contractors with a broad overview on the CDM Regulations 2015.<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>understand the need and application of the CDM regulations;<\/li>\n<li>appreciate the framework of the regulations and the interfaces between the key parties; and<\/li>\n<li>understand the duties and responsibilities of the client, principal designer, designers, principal contractor and contractors.<\/li>\n<\/ul>\n<h3>CDM2015 Client<\/h3>\n<p>This 1 day course is designed to provide personnel who are tasked by their organisation to perform the Client\u2019s duties with a sound understanding of the Client\u2019s responsibilities &amp; duties under the CDM regulations 2015 and what should be expected of the principal designer, designers, the principal contractor and contractors.<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>understand the obligations placed on Clients by the CDM Regulations 2015;<\/li>\n<li>make effective management arrangements and ensure compliance;<\/li>\n<li>appreciate the information requirements; and<\/li>\n<li>understand the requirements for the Health and Safety File<\/li>\n<\/ul>\n<h3>CDM2015 Design Phase Risk Management Co-ordination<\/h3>\n<p>This 3 day course is aimed at those persons who will be performing the duties of the Principal Designer on behalf of their employer, who has been appointed to this role by the Client. It provides knowledge on the requirements, methods that could be used to achieve these requirements and the personal qualities necessary. The course also provides for the additional services that could be offered by the Principal Designer for advising and assisting the client with the Client\u2019s duties.<\/p>\n<p>This course is currently being considered for accreditation by the Association for Project Safety (APS).<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>understand the principal designer\u2019s duties under the CDM regulations 2015;<\/li>\n<li>know how to ensure effectively cooperation, coordination and communication during the design;<\/li>\n<li>be familiar and confident in the supply of information and production of evidence; and<\/li>\n<li>be able to advise and assist the client with the client\u2019s duties, if required.<\/li>\n<\/ul>\n<h3>Pre-Course Requirements<\/h3>\n<p>Those who wish to undertake this course should be familiar with and have knowledge of the construction industry and construction health and safety which is deemed to include:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>an appreciation of H&amp;S Law, Approved Codes of Practice and guidance applying to construction works;<\/li>\n<li>an understanding on how the construction industry is organised and works, including different forms of procurement and contracts; and<\/li>\n<li>an understanding of their individual and company responsibilities under H&amp;S Law.<\/li>\n<\/ul>\n<h3>CDM2015 Design Phase Risk Management Co-ordination<\/h3>\n<p>This 2 day course is aimed at Principal Designers and Design Risk Managers who manage the requirements of design risk and CDM2015 for Designers.<\/p>\n<p>This course is currently being considered for accreditation by the Association for Project Safety (APS).<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>understand the principal designers\u2019 duties under the CDM regulations 2015;<\/li>\n<li>know how to effectively reduce risk by design; and<\/li>\n<li>be familiar and confident in the supply of information and production of evidence.<\/li>\n<\/ul>\n<h3>Pre-Course Requirements<\/h3>\n<p>Those who wish to undertake this course should be familiar with and have knowledge of the construction industry and construction health and safety which is deemed to include:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>an appreciation of H&amp;S Law, Approved Codes of Practice and guidance applying to construction works;<\/li>\n<li>an understanding on how the construction industry is organised and works, including different forms of procurement and contracts; and<\/li>\n<li>an understanding of their individual and company responsibilities under H&amp;S Law.<\/li>\n<\/ul>\n<h3>CDM2015 Reducing Risk by Design<\/h3>\n<p>This 1 day is designed to provide personnel who perform the duties of a Designer with the necessary knowledge and confidence in the performance of the task for full compliance with the designers\u2019 duties under CDM2015.<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>recognise the range of persons who would be considered to be designers;<\/li>\n<li>fully understand the designers\u2019 duties under the CDM regulations;<\/li>\n<li>know how to effectively reduce risks by design; and<\/li>\n<li>record the design decisions in an efficient manner.<\/li>\n<\/ul>\n<h3>CDM2015 Principal Contractor and Contractors<\/h3>\n<p>This 1 day is designed to provide principal contractors and contractors with the management requirements of the Construction (Design and Management) Regulations 2015 (CDM2015).<\/p>\n<h3>Course Objectives<\/h3>\n<p>Upon completion of the course, delegates should:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>understand the obligations placed on all persons involved by the CDM regulations;<\/li>\n<li>understand the extent and benefits of effective risk assessments and method statements;<\/li>\n<li>know the requirements for the construction phase plan and site health and safety management; and<\/li>\n<li>appreciate what checks should be performed prior to engaging other parties and the checks to be performed during the work.<\/li>\n<\/ul>\n<p>All of the courses are offered as \u2018in-house\u2019 courses, where the trainer presents the course at a venue provided by the delegates\u2019 employer, and are priced at a daily rate.<\/p>\n<p>Publicly available courses will also be arranged for some of the courses.<\/p>\n<div class=\"mk-custom-module-container\">\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Today, 29th January 2015, CDM2015 gained parliamentary approval, and will therefore come into force on 6th April 2015.
