{"id":147755,"date":"2025-01-24T14:55:53","date_gmt":"2025-01-24T14:55:53","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=147755"},"modified":"2025-01-24T14:55:53","modified_gmt":"2025-01-24T14:55:53","slug":"cma-construction-chemicals-investigation-dropped-after-over-year","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/hr-skills-news\/cma-construction-chemicals-investigation-dropped-after-over-year\/147755\/","title":{"rendered":"CMA construction chemicals investigation dropped after a year"},"content":{"rendered":"<h2>The Competition and Markets Authority has closed a case into suspected anti-competitive conduct in relation to construction chemical supply on the grounds of administrative priority<\/h2>\n<p>The CMA construction chemicals investigation was <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/cma-anti-competitive-conduct\/133548\/\">originally opened on 17 October 2023.<\/a><\/p>\n<p>The investigation was opened due to suspicions that certain suppliers of construction chemicals were breaching Chapter I of the Competition Act 1998.<\/p>\n<h3>The CMA construction chemicals investigation lasted a year and four months<\/h3>\n<p><a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/8-107-5887?contextData=(sc.Default)&amp;transitionType=Default&amp;firstPage=true#:~:text=Chapter%20I%20of%20the%20Competition%20Act%201998%20prohibits,the%20UK%20and%20which%20affect%20trade%20within%20the\">Chapter I of the Competition Act 1998<\/a> \u201cChapter I of the Competition Act 1998 prohibits agreements, decisions and\u00a0concerted practices\u00a0between or among undertakings or associations of undertakings which have as their object or effect the restriction, distortion or prevention of competition within the UK and which affect trade within the UK.\u201d<\/p>\n<p>The investigation was not small \u2013 involving authorities from the European Commission and the United States Department of Justice \u2013 Antitrust Division.<\/p>\n<p>The anti-competitive conduct involved the supply of chemical admixtures and additives for products such as concrete, mortars, and cement.<\/p>\n<p>Last September, a report by CMS stated that <a href=\"https:\/\/www.pbctoday.co.uk\/news\/hr-skills-news\/cms-report-says-cma-investigations-are-intensifying\/144029\/\" target=\"_blank\" rel=\"noopener\">investigations by the CMA are intensifying,<\/a> with 164 investigations having been conducted since the introduction of the Competition Act in 1998, 50% of which ended in an infringement decision.<\/p>\n<p>All the construction-related cases involved a dawn raid, and 88% of construction investigations ended in an infringement decision.<\/p>\n<h3>The case has been closed with no decision made<\/h3>\n<p>The summary of the closure decision reads: \u201cThe CMA has closed its investigation into suspected anti-competitive conduct relating to the supply of chemical admixtures and additives for use in concrete, cement, mortars and related construction products in the UK on the grounds that the investigation no longer constitutes an administrative priority. This decision does not amount to a statement or finding as to whether the parties to the investigation have infringed competition law, nor should any inference be made to that effect.<\/p>\n<p>\u201cThe CMA launched an investigation under Chapter I of the CA98 on 17 October 2023 because it had reasonable grounds for suspecting that certain suppliers of these chemicals and certain industry bodies had breached Chapter I of the CA98.<\/p>\n<p>\u201cFollowing a period of evidence gathering and assessment, the CMA considered whether to continue with the investigation in light of its Prioritisation Principles. The Prioritisation Principles set out the factors that the CMA considers before deciding whether to take action. To make efficient and effective use of public resources, the CMA needs to ensure it takes appropriate decisions about which projects and programmes of work it prioritises (and continues to prioritise), to have the greatest impact across the breadth of its work.<\/p>\n<p>\u201cHaving given the parties the opportunity to comment on the CMA\u2019s proposed action, the CMA has decided to discontinue its investigation into all parties involved on the grounds of administrative priorities. In taking this decision, the CMA carefully assessed the evidence obtained and had regard to its Prioritisation Principles and to the CMA\u2019s other current priorities in its overall portfolio of work.
