{"id":152459,"date":"2025-06-23T11:45:30","date_gmt":"2025-06-23T10:45:30","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=152459"},"modified":"2025-06-23T11:49:23","modified_gmt":"2025-06-23T10:49:23","slug":"acqp-calls-immediate-removal-building-safety-regulator-from-hse","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/acqp-calls-immediate-removal-building-safety-regulator-from-hse\/152459\/","title":{"rendered":"ACQP calls for immediate removal of Building Safety Regulator from HSE"},"content":{"rendered":"<h2>The Association of Construction and Quality Professionals claims that the BSR risks repeating the &#8220;very regulatory failures it was designed to prevent\u201d<\/h2>\n<p>The Association of Construction and Quality Professionals (ACQP) has called for the removal of the <a href=\"https:\/\/www.hse.gov.uk\/building-safety\/regulator.htm\" target=\"_blank\" rel=\"noopener\">Building Safety Regulator (BSR) from the Health and Safety Executive (HSE)<\/a>, citing critical structural and cultural incompatibilities that are undermining its ability to deliver the post-Grenfell reforms intended by the Building Safety Act.<\/p>\n<p>In a statement issued to members and media, the ACQP said the current arrangement \u201crisks repeating the very regulatory failures it was designed to prevent.\u201d<\/p>\n<p>\u201cThe BSR was meant to reset the culture of construction safety in the UK. But housing it within the HSE , an organisation whose expertise lies in workplace safety, has led to confusion, weak enforcement, and an alarming lack of sector engagement,\u201d said Gerry Sharpe, CEO.<\/p>\n<h3>Key concerns raised by the ACQP:<\/h3>\n<h4>\u2022 Lack of built environment expertise:<\/h4>\n<p>The HSE is not a construction regulator. Its staff, systems and oversight frameworks are not designed to deal with building control, cladding, fire engineering or long-term structural risks.<\/p>\n<h4>\u2022 Slow and ineffective enforcement:<\/h4>\n<p>ACQP members report delayed interventions on high-risk buildings, with many unsafe structures still occupied and unresolved years after issues were flagged.<\/p>\n<h4>\u2022 Low visibility and engagement:<\/h4>\n<p>There is widespread concern that the BSR is distant, bureaucratic and disconnected from the professionals and residents it is meant to support.<\/p>\n<h4>\u2022 Cultural misalignment:<\/h4>\n<p>The HSE\u2019s long-standing risk-based, reactive enforcement culture does not align with the proactive, high-stakes demands of modern building safety oversight.<\/p>\n<h3>The ACQP is calling for the government to:<\/h3>\n<ul>\n<li>Immediately begin the process of removing the BSR from the HSE,<\/li>\n<li>Establish the BSR as an independent statutory body with its own governance, staffing and powers,<\/li>\n<li>Appoint leadership drawn from across the construction, fire safety, and resident advocacy sectors,<\/li>\n<li>Improve transparency and public accountability of BSR decisions and enforcement actions,<\/li>\n<li>Foster stronger integration with local authorities, fire services, building control, and planning regulators.<\/li>\n<\/ul>\n<p>\u201cWe believe in a regulator that is feared by cowboys, trusted by residents, and respected by professionals,&#8221; the statement went on to say. &#8220;That will never be achieved while it remains buried in the wrong institution.\u201d<\/p>\n<h3>The call for removal comes after a bumpy first year for the Building Safety Regulator<\/h3>\n<p>The BSR celebrated it&#8217;s <a href=\"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/the-building-safety-regulator-celebrates-its-1st-birthday\/145511\/\" target=\"_blank\" rel=\"noopener\">first birthday<\/a> in November 2024, after a first year of lukewarm welcome from the construction industry. Building control surveyors were required to register with the BSR by April 2024 or would no longer be allowed to practice.<\/p>\n<p>A <a href=\"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/building-safety-regulator-sparks-anxiety-among-building-control-surveyors\/137519\/\" target=\"_blank\" rel=\"noopener\">survey by Hertfordshire Building Control <\/a>found that whilst surveyors understood the reasoning, over 60% of those surveyed were &#8216;annoyed, reluctant or worried&#8217; about having to register and were futher concerned about if the registration process may turn away newcomers to the surveying profession, whilst driving out older professionals entirely.<\/p>\n<div
