{"id":152490,"date":"2025-06-26T13:00:31","date_gmt":"2025-06-26T12:00:31","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=152490"},"modified":"2025-06-26T13:16:07","modified_gmt":"2025-06-26T12:16:07","slug":"what-going-with-building-safety-regulator","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/what-going-with-building-safety-regulator\/152490\/","title":{"rendered":"What is going on with the Building Safety Regulator?"},"content":{"rendered":"<h2>The Building Safety Regulator has come under fire this week with damning calls from the ACQP to remove the BSR from HSE, followed by the announcement that Philip White is \u00a0\u201cpartially retiring\u201d as he steps down from the role of director of building safety<\/h2>\n<p>The BSR acts as the authority for High Rise Buildings (HRBs) in England, prioritising safety and quality in these buildings intended for residential or commercial use, as well as ensuring that all applications meet the legal requirements for HRBs.<\/p>\n<p>However, the <a href=\"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/acqp-calls-immediate-removal-building-safety-regulator-from-hse\/152459\/\" target=\"_blank\" rel=\"noopener\">ACQP are accusing the BSR of:<\/a><\/p>\n<h4>Lack of built environment expertise<\/h4>\n<p>The HSE is not a construction regulator. Its staff, systems and oversight frameworks are not designed to deal with building control, cladding, fire engineering or long-term structural risks.<\/p>\n<h4>Slow and ineffective enforcement<\/h4>\n<p>ACQP members report delayed interventions on high-risk buildings, with many unsafe structures still occupied and unresolved years after issues were flagged.<\/p>\n<h4>Low visibility and engagement<\/h4>\n<p>There is widespread concern that the BSR is distant, bureaucratic and disconnected from the professionals and residents it is meant to support.<\/p>\n<h4>Cultural misalignment<\/h4>\n<p>The HSE\u2019s long-standing risk-based, reactive enforcement culture does not align with the proactive, high-stakes demands of modern building safety oversight.<\/p>\n<p>They are now calling on the government to remove the BSR from HSE and make it their own independent statutory body with its own governance, staffing, and powers.<\/p>\n<p>This would address the issue with a lack of expertise, as leadership can be taken from the construction, fire safety, and resident advocacy sectors.<\/p>\n<h3>Multidisciplinary safety teams to be brought into BSR<\/h3>\n<p>Before stepping down later this year, Philip White has stated he is considering bringing in tall-building safety specialist teams in an attempt to reduce the time it is taking to work through the backlog, something the BSR has been criticised for recently.<\/p>\n<p>The idea is somewhat controversial, however, with the building safety register, Matt Hodges-Long, asking whether this move would be worth it, and calling the BSR \u201cnot fit for purpose\u201d.<\/p>\n<p>A representative of the BSR said: &#8220;BSR is looking at how it resources the MDTs that assess applications to enable these teams to be stood up more quickly.<\/p>\n<p>\u201cThese teams consist of registered building inspectors, fire and rescue service personnel and other specialist skills.<\/p>\n<p>\u201cIt is important to ensure that both industry and BSR play their part in delivering long-lasting high-quality new homes, and these measures take a significant step towards the delivery of 1.5 million new, high-quality and safe homes.\u201d<\/p>\n<h3>BSR under investigation<\/h3>\n<p>Less than a week ago, the House of Lords launched an inquiry into the BSR regarding delays in construction caused by slow approval processes. This has resulted in a significant backlog and is preventing contractors from commencing work.<\/p>\n<p>The BSR website states: \u201cWe acknowledge that many applications have taken longer than anticipated to process. But we\u2019re having to reject around 70% of applications because they don\u2019t meet the legal requirements. This isn\u2019t \u2018red tape\u2019 for the sake of it. We\u2019re preventing risks and problems from being designed into the built environment.\u201d<\/p>\n<p>Several industry voices are speaking against the Building Safety Regime, which was launched in April 2023.<\/p>\n<p>Figures from Cast show that a measly 10.8% of Gateway 2 new project applications have been approved to date. Furthermore, 20 new project applications have been approved out of 187, following assessment delays.<\/p>\n<p><a href=\"https:\/\/committees.parliament.uk\/committee\/517\/industry-and-regulators-committee\/news\/207876\/industry-and-regulators-committee-seeks-views-on-building-safety-regulator\/\" target=\"_blank\" rel=\"noopener\">The inquiry seeks evidence from<\/a> building industry specialists, housing associations, architects, resident groups, safety experts, local authorities and other relevant stakeholders.<\/p>\n<p>Baroness Taylor of Bolton, chair of the Industry and Regulators Committee, said: \u201cThe Committee wants to hear from all stakeholders to find out if the BSR has the skills and resources required to ensure the safety of all buildings and its residents in the process of approving applications for high-rise buildings.<\/p>\n<p>\u201cThis is crucial if the Government is going to achieve its manifesto target of building 1.5 million homes over the next Parliament.\u201d<\/p>\n<h3>Philip White is stepping down<\/h3>\n<p>Yesterday,\u00a0<span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\"><a href=\"https:\/\/www.pbctoday.co.uk\/news\/people\/building-safety-regulator-director-step-down-after-two-years-role\/152486\/\" target=\"_blank\" rel=\"noopener\">Philip White, the di<\/a><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\"><a href=\"https:\/\/www.pbctoday.co.uk\/news\/people\/building-safety-regulator-director-step-down-after-two-years-role\/152486\/\" target=\"_blank\" rel=\"noopener\">rector of the Building Safety Regulator, announced his partial retirement<\/a> in September, but will continue in his role as Chief Inspector of Buildings<\/span>\u00a0at the\u00a0<\/span>HSE.<\/p>\n<p>This is a tumultuous time to question the leadership of the regulator, and it is hard not to think that this clear expression of distrust in the BSR has something to do with it.<\/p>\n<p>A spokesman for the HSE said: \u201cPhilip White has served as interim Director of Building Safety at the Building Safety Regulator since December 2023.<\/p>\n<p>\u201cMr White\u2019s decision to only partially retire means that BSR will continue to benefit from his extensive experience as it enters its second year of operation.<\/p>\n<p>\u201cThe BSR is in the process of recruiting a permanent Director of Building Safety.
