{"id":26206,"date":"2016-09-09T11:30:46","date_gmt":"2016-09-09T11:30:46","guid":{"rendered":"http:\/\/planningandbuildingcontroltoday.co.uk\/?p=25724"},"modified":"2016-10-11T12:49:12","modified_gmt":"2016-10-11T12:49:12","slug":"fine-flooring-company-safety-failings","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/fine-flooring-company-safety-failings\/26206\/","title":{"rendered":"Fine for flooring company after safety failings"},"content":{"rendered":"<h2>A flooring company has received a fine for failing to ensure health and safety after a worker was injured onsite\u2026<\/h2>\n<p>A self-employed contractor working with Technic Concrete Floors Limited was injured due to safety failings.<\/p>\n<p>The contractor, Steven Stewart, was walking across a floor that was under construction at an Edinburgh retail park in 2014 when his foot dislodged an unsecured wooden panel covering a void in the floor. The worker fell some 4.5 metres. He landed on steel mesh grids on the ground below.<\/p>\n<p>As a result of the fall Stewart sustained serious back injuries as well as a broken foot.<\/p>\n<p>The case was brought before Edinburgh Sherriff Court after a <a href=\"http:\/\/www.hse.gov.uk\/\" target=\"_blank\">Health and Safety Executive<\/a> (HSE) investigation found that if a dynamic risk assessment had been carried out prior to the task the voids might have been flagged as being inadequately protected.<\/p>\n<p>HSE ruled that with proper planning and supervision the incident could have been avoided.<\/p>\n<p>The firm, which is based in Lancashire, pleaded guilty to a contravention of Regulation 4 of the Work at Height Regulations 2005, and Section 33(1)(c) of the Health and Safety at Work Act 1974. It received a fine of \u00a33,300.<\/p>\n<p>Gary Aitken, head of the Crown Office health and safety division, said: \u201cThis was an accident that resulted in life changing injuries that could have been avoided if the appropriate measures had been in place at the time.<\/p>\n<p>\u201cThis incident could well have proved fatal and it has irrevocably changed Mr. Stewart\u2019s life.<\/p>\n<p>\u201cFalls from height are usually the greatest single cause of death and serious injury to workers within the construction industry.<\/p>\n<p>\u201cHopefully this prosecution will remind other employers that failure to fulfil their obligations can have terrible consequences and that they will be held to account for their failings.\u201d<\/p>\n<div class=\"mk-custom-module-container\">\n<\/div>","protected":false},"excerpt":{"rendered":"<p>A flooring company has received a fine for failing to ensure health and safety after a worker was injured onsite.<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[309],"tags":[432],"stakeholder_rel_tag":[],"contributor_rel_tag":[],"class_list":{"0":"post-26206","1":"post","2":"type-post","3":"status-publish","4":"format-standard","6":"category-health-safety-news","7":"tag-health-safety"},"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v26.9 (Yoast SEO v26.9) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Fine for flooring company after safety failings | Planning, Building &amp;
