{"id":30967,"date":"2017-02-16T15:55:54","date_gmt":"2017-02-16T15:55:54","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=30967"},"modified":"2017-02-16T15:55:54","modified_gmt":"2017-02-16T15:55:54","slug":"construction-equipment-firm-fined","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/construction-equipment-firm-fined\/30967\/","title":{"rendered":"Construction equipment hire firm fined after a worker is killed"},"content":{"rendered":"<h2>A Warwickshire-based construction equipment hire company has been prosecuted for safety failings following the death of an employee<\/h2>\n<p>AGD Equipment, based in Warwickshire, has received an \u00a3800,000 fine after a worker was killed.<\/p>\n<p>The worker, 49-year-old Mark Seward had only been in the employ of the firm for 16 days when he died.<\/p>\n<p>The case, which was brought before Warwick Crown Court, revealed how Seward was testing a hydraulic cylinder when the incident occurred. It reportedly cracked under the pressure and Seward was hit in the head with a chunk of metal.<\/p>\n<h3>Investigation<\/h3>\n<p>The subsequent <a href=\"http:\/\/www.hse.gov.uk\" target=\"_blank\">Health and Safety Executive<\/a> (HSE) investigation revealed <a href=\"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/construction-worker-injury-aberdeen\/30906\" target=\"_blank\">safety failings<\/a> were behind the event, as AGD failed to provide adequate supervision for the task being undertaken.<\/p>\n<p>The firm pleaded guilty of breaching the Provision &amp; Use of Work Equipment Regulations 1998 the Management of Health and Safety at Work Regulations 1999.<\/p>\n<p>Furthermore, AGD also pleaded guilty to breaching the Health and Safety at Work Act 1974.<\/p>\n<p>As a result of the court case the firm was fined \u00a3800,000 and ordered to pay costs of \u00a328,711.<\/p>\n<p>HSE inspector Neil Ward said: &#8220;This was a tragic incident that should never have occurred.<\/p>\n<p>&#8220;It is a company\u2019s obligation to provide a safe system of work for leak testing.
