{"id":35803,"date":"2017-10-20T12:35:09","date_gmt":"2017-10-20T11:35:09","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=35803"},"modified":"2017-10-27T12:23:57","modified_gmt":"2017-10-27T11:23:57","slug":"met-police-accused-of-blocking-grenfell-foi-requests","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/met-police-accused-of-blocking-grenfell-foi-requests\/35803\/","title":{"rendered":"Met Police accused of \u2018blocking\u2019 Grenfell FoI requests"},"content":{"rendered":"<h2>Metropolitan Police have reportedly\u00a0asked to vet any release of information relating to Kensington and Chelsea Council action on fire safety advice<\/h2>\n<p>The Metropolitan Police is reportedly vetting Freedom of Information <a href=\"https:\/\/www.gov.uk\/make-a-freedom-of-information-request\">(FoI) requests<\/a> to Kensington and Chelsea Council (<a href=\"https:\/\/www.rbkc.gov.uk\/\">RBKC<\/a>) that would outline action taken to mitigate fire risks at Grenfell Tower.<\/p>\n<p>These requests relate to the council\u2019s response after it was\u00a0warned by <a href=\"http:\/\/www.london-fire.gov.uk\/\">London Fire Brigade <\/a>(LFB) about the potential risks of cladding at <a href=\"https:\/\/www.pbctoday.co.uk\/news\/building-control-news\/javid-provides-update-grenfell-tower\/34801\">Grenfell <\/a>and other buildings.<\/p>\n<p>The Met says its advice does not constitute an order to withhold the information.<\/p>\n<p>LFB wrote to all 33\u00a0London councils in April \u2013 two months before the disaster \u2013 after concluding that cladding had contributed to another fire in Hammersmith, west London.<\/p>\n<p>However, despite repeated requests under FoI about what Kensington authorities did following that warning, the council is said to have refused to provide answers.<\/p>\n<p>Now, the council says it has been advised by the police not to release the information amid fears it could interfere with the criminal investigation that officers are carrying out with the view that \u201cdisclosure would or would be likely to prejudice the prevention or detection of crime or the apprehension of prosecution of offenders.\u201d<\/p>\n<p>The LFB warned all the capital\u2019s councils they should check cladding was\u00a0up to standard, and \u201ctake account of other fire-safety measures already in place in the building as well as potential mitigation measures to ensure that any potential fire spread does not pose a risk to health and safety\u201d.<\/p>\n<p>This warning followed a fire at the Shepherd\u2019s Court flats in Hammersmith in August 2016, which the fire service\u00a0believed was exacerbated by\u00a0external panels.<\/p>\n<p>The Met has reportedly been asked to see any information about Grenfell\u00a0Tower\u00a0RBKC is considering for release under FoI.<\/p>\n<p>Addressed to its director of housing, the LFB letter was forwarded by the council to Kensington and Chelsea Tenant Management Organisation (<a href=\"http:\/\/www.kctmo.org.uk\/\">KCTMO<\/a>) which was removed of its management of Grenfell Tower after the fire.<\/p>\n<p>The council is dealing with all FoI requests relating to the work of KCTMO.<\/p>\n<p>So far, seven FoI requests have been submitted. Four requests have been denied, two are in progress and one has been granted.<\/p>\n<p>A Kensington and Chelsea Council spokesman said: \u201cWe are responding to Freedom of Information requests relating to the Grenfell Tower fire tragedy as we would do on any other request of this nature.<\/p>\n<p>\u201cAny item or documentation requested from us, be it Grenfell Tower-related or any other council business, we will disclose in accordance with the Freedom of Information Act and independently of the police or any other external organisation.<\/p>\n<p>A Metropolitan Police spokesman said the service will consider taking every possible legal step to prevent the Grenfell investigation from being prejudiced.<\/p>\n<p>\u201cAs such we are made aware of and consulted on whether\u00a0the release of material under the Freedom of Information Act, at this stage, may prejudice this ongoing investigation.<\/p>\n<p>\u201cThe act allows for such consultation to take place, and there are relevant exemptions for non-release of material that may prejudice, at this stage, an ongoing criminal investigation.<\/p>\n<p>\u201cThe release of material remains the decision of the organisation who holds it.\u201d<\/p>\n<p>&nbsp;<\/p>\n<div class=\"mk-custom-module-container\">\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Metropolitan Police have reportedly\u00a0asked to vet any release of information relating to Kensington and Chelsea Council action on fire safety advice The Metropolitan Police is reportedly vetting Freedom of Information (FoI) requests to Kensington and Chelsea Council (RBKC) that would outline action taken to mitigate fire risks at Grenfell Tower.
