{"id":40039,"date":"2018-04-03T10:17:07","date_gmt":"2018-04-03T09:17:07","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=40039"},"modified":"2018-04-20T14:17:02","modified_gmt":"2018-04-20T13:17:02","slug":"renters-to-benefit-from-new-crackdown-on-rogue-agents","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/renters-to-benefit-from-new-crackdown-on-rogue-agents\/40039\/","title":{"rendered":"Renters &#038; leasehold homeowners to benefit from new crackdown on rogue agents"},"content":{"rendered":"<h2>Around 9 million households in England\u2019s private rented and leasehold sectors are to benefit from stronger protections against rogue letting and managing agents as a result of new government proposals announced on 1 April<\/h2>\n<p>With thousands of <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/rental-sector-in-the-dark-over-rights\/36362\/\">renters and leaseholders<\/a> suffering at the hands of rogue agents every day from unexpected costs, intentionally vague bills or poor quality repairs, a new mandatory code of practice is proposed to stop managing and letting agents from flouting the law.<\/p>\n<p>To further professionalise the sectors, letting and managing agents will be required to obtain a nationally recognised qualification to practice, with at least 1 person in every organisation required to have a higher qualification.<\/p>\n<p>A new independent regulator responsible for working practices of agents will be given strong powers of enforcement for those who break the rules \u2013 and agents who fail to comply will not be permitted to trade. Criminal sanctions could also be brought in for those who severely breach the code.<\/p>\n<p>Housing Minister Heather Wheeler said: \u201cMost property agents take a thorough and professional approach when carrying out their business, but sadly some do not.<\/p>\n<p>\u201cBy introducing new standards for the sector, we will clamp down on the small minority of agents who abuse the system so we can better protect tenants and leaseholders who find themselves at the end of a raw deal.\u201d<\/p>\n<h3>Other proposals to be brought in under the code of practice include:<\/h3>\n<ul>\n<li>A new system to help leaseholders challenge unfair fees including service charges;<\/li>\n<li>Support for leaseholders to switch their managing agents where they perform poorly or break the terms of their contract;<\/li>\n<li>A requirement for all letting and managing agents to undertake continuing professional development and training.<\/li>\n<\/ul>\n<p>The new code will be developed by a working group comprising representatives of letting, managing and estate agents, as well as tenants and regulation experts. The group will be established as soon as possible and is expected to draw up the final proposals in early 2019.<\/p>\n<p>The group will also look in greater depth at <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/generation-rent-affected-the-most-by-deposit-black-hole\/38080\/\">unfair additional charges for freehold and leaseholders<\/a> and whether they should be capped or banned.
