{"id":56583,"date":"2019-05-07T12:34:34","date_gmt":"2019-05-07T11:34:34","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=56583"},"modified":"2019-05-08T11:29:50","modified_gmt":"2019-05-08T10:29:50","slug":"tunnelling-underground-contract-the-emerald-book","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/tunnelling-underground-contract-the-emerald-book\/56583\/","title":{"rendered":"FIDIC teams up with ITA-AITES for new underground works contract"},"content":{"rendered":"<h2><a href=\"http:\/\/fidic.org\/\">FIDIC<\/a> (the International Federation of Consulting Engineers) and <a href=\"https:\/\/www.ita-aites.org\/\">ITA-AITES<\/a> (the International Tunnelling and Underground Space Association) have teamed up to publish a new form of contract for tunnelling and underground works, The Emerald Book<\/h2>\n<p>With <a href=\"https:\/\/www.pbctoday.co.uk\/news\/bim-news\/digital-map-underground-pipes\/56053\/\">underground construction<\/a>, a fast-growing market sector due to the increasing demand for use of underground space for infrastructure, the new Conditions of Contract for Underground Works (The Emerald Book) should be widely used.<\/p>\n<p>Underground construction is highly dependent on the geological, hydrogeological and geotechnical properties of the ground, which have a defining influence on the methods required for the successful implementation of the works. In addition, the difficulty in predicting ground behaviour and foreseeable conditions implies an inherent uncertainty in underground construction which gives rise to unique contractual risks regarding construction practicability, time and cost.<\/p>\n<p>These risks are addressed in the Conditions of Contract for Underground Works (The Emerald Book), which is being launched on Tuesday 7 May 2019 at the World Tunnel Congress 2019 in Naples. The launch follows several years of intensive work by a joint task group of representatives of FIDIC and ITA-AITES who identified several issues that the new standard form of contract should address to promote equitable risk allocation and the effective dealing with conditions typically unforeseeable in such projects.<\/p>\n<p>These issues include the following key areas, all of which have been specifically addressed in the new contract.<\/p>\n<ul>\n<li>Allocation of risk.<\/li>\n<li>Disclosure of all available geological and geotechnical information.<\/li>\n<li>Inclusion of a contractual geotechnical baseline.<\/li>\n<li>Inclusion of a tailored \u201cUnforeseeable Physical Conditions\u201d clause.<\/li>\n<li>Implementation of a ground classification system and of supporting particular conditions that properly reflect the effort of excavation and stabilisation.<\/li>\n<li>Time for completion is largely influenced by ground conditions.<\/li>\n<li>Provision of a flexible mechanism for remuneration according to ground conditions, foreseen and unforeseen.<\/li>\n<\/ul>\n<p>With working underground a growing market in a number of areas including energy, transportation, <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/housing-infrastructure-time-bomb\/56188\/\">urban infrastructure<\/a> and as a result of space shortages in cities due to population increases, take-up of the new Emerald Book contract is expected to be widespread.<\/p>\n<p>Commenting on the launch of the contract, FIDIC contracts committee chair Zolt\u00e1n Z\u00e1honyi said: \u201cWorking together, FIDIC and ITA-AITES have created a contract that we believe, and hope will command the respect and authority of the tunnel engineering and construction sector and that both clients and contractors can use with confidence.<\/p>\n<p>&#8220;The new Emerald Book addresses several critical areas that should lead to the smoother running of contracts in the growing tunnelling and underground works sector.\u201d<\/p>\n<p>Tarcisio Celestino, president of the International Tunnelling and Underground Space Association, commented: \u201cThe Emerald Book will bridge an important gap.
