The Professional Conduct Committee<\/a> (PCC) has issued architect Gordon Simpson of Art Hand Ltd, with a penalty order of \u00a31,500 following unacceptable professional conduct<\/h2>\n

The PCC heard that Gordon Simpson had been instructed to provide a full architectural service in relation to the design and construction of a low energy, low maintenance timber frame house.\u00a0<\/p>\n

His clients complained to the Architects Registration Board<\/a> (ARB) after the architect failed to respond to their letters of complaint.<\/p>\n

Allegedly, Gordon Simpson failed to manage a conflict of interest, in that he was acting as both architect and contractor and failed to ensure the build was carried out in accordance with planning permission<\/a>.<\/p>\n

He also allegedly failed to pay subcontractors<\/a>, and failed to deal with a dispute about his professional work in an appropriate manner.<\/p>\n

On consideration of the evidence, the PCC found that Simpson was not guilty of unacceptable professional conduct with regards to the alleged failure to pay subcontractors.\u00a0However, the remaining allegations were found proved.<\/p>\n

When deciding the appropriate sanction, the PCC considered Gordon Simpson\u2019s good disciplinary history, his engagement with the disciplinary process and his regret for his failings.\u00a0<\/p>\n

The PCC also noted the severe adverse consequences for the clients, who were at risk of having their property demolished.\u00a0Taking all these factors into account, the PCC concluded a penalty order of \u00a31,500 was the appropriate sanction.<\/p>\n
