{"id":67479,"date":"2019-11-15T10:44:49","date_gmt":"2019-11-15T10:44:49","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=67479"},"modified":"2019-11-15T10:44:49","modified_gmt":"2019-11-15T10:44:49","slug":"health-and-safety-requirements","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/health-and-safety-requirements\/67479\/","title":{"rendered":"Scaffolding company fined \u00a31,283 for breaching safety requirements"},"content":{"rendered":"<h2>A scaffolding company had been prosecuted after failing to reach Health and Safety requirements, resulting in fines and costs totalling \u00a31,283<\/h2>\n<p>The case was heard at <a href=\"https:\/\/courttribunalfinder.service.gov.uk\/courts\/bromley-magistrates-court\" target=\"_blank\" rel=\"noopener noreferrer\">Bromley Magistrates\u2019 Court<\/a> with JCS Scaffolding Services Limited of Acorn Close Romford pleading guilty resulting in fines and costs totalling \u00a31,283.<\/p>\n<p>\u201cThe council has a duty to protect the public and this includes issuing licenses for scaffolding on the public highway. When an application is processed, we will notify the applicant of the outcome but under no circumstances should any structure, including scaffolding, be placed on the highway until a licence has been approved and received,\u201d said a council spokesperson.<\/p>\n<p>During July, the council received a report that scaffolding had been erected at a property in Mottingham Road SE9. without a licence or adhering to the relevant health and safety requirements.<\/p>\n<p>Following an investigation, the company failed to rectify the issues highlighted to them and as users of the public highway were put at risk, prosecution followed.<\/p>\n<p>Under the Highways Act 1980 Section 169, the council grants permission for a variety of structures to be placed on its highways <a href=\"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/scaffold-company-fined\/58385\/\" target=\"_blank\" rel=\"noopener noreferrer\">including scaffolding<\/a>, builders skips, building materials and hoarding.<\/p>\n<p>Licences give permission for the structure to be on the highway for a set period of time.
