{"id":73434,"date":"2020-03-18T10:03:12","date_gmt":"2020-03-18T10:03:12","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=73434"},"modified":"2020-03-18T10:06:51","modified_gmt":"2020-03-18T10:06:51","slug":"ring-fenced-cash-retention","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/ring-fenced-cash-retention\/73434\/","title":{"rendered":"SELECT calls for ring-fenced cash retention scheme in Scotland"},"content":{"rendered":"<h2>The campaigning body for the electrotechnical industry in Scotland, <a href=\"https:\/\/www.select.org.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">SELECT<\/a>, has urged Holyrood to introduce a statutory obligation to place cash retentions in a ring-fenced retention deposit scheme<\/h2>\n<p>In a detailed response, SELECT has stated its long-held view that Holyrood should introduce a statutory obligation to place cash retentions in a ring-fenced retention deposit scheme.<\/p>\n<p>It has also pointed out to its 1,250 member businesses that the consultation closes on 25 March 2020, and is encouraging all firms in <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/scotland-cash-retentions\/73136\/\" target=\"_blank\" rel=\"noopener noreferrer\">Scotland\u2019s construction industry<\/a> to follow its lead and take part.<\/p>\n<p>Cash retentions are deducted from due payments, ostensibly as security in case a firm fails to return to remedy non-compliant work.<\/p>\n<p>In practice, the monies \u2013 which belong to the firms from whom they have been withheld \u2013 are often used to bolster the cashflow of clients and Tier 1 contractors.<\/p>\n<p>In its <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/cash-retention-consultation\/68818\/\" target=\"_blank\" rel=\"noopener noreferrer\">response to the consultation<\/a>, SELECT said: \u201cWe must aim to bring all value contracts within scope of our proposed deposit scheme so that small businesses which bear the brunt of retentions abuse are protected.<\/p>\n<p>\u201cA suggestion to place a cap on the value of contracts subject to the scheme, or any other type of cap, could exclude the very firms that require most protection.&#8221;<\/p>\n<h3>SELECT listed the benefits of a ring-fenced scheme backed by adjudication:<\/h3>\n<ul>\n<li>Monies ring-fenced in the scheme can provide collateral for borrowing, thus increasing liquidity for SMEs<\/li>\n<li>Disputes over the release of cash retentions will be resolved quickly since neither party has control over the monies<\/li>\n<li>Since retention monies will not be available to be used and abused, the demand for cash retentions is likely to be reduced, thus placing a greater focus on selecting competent firms.<\/li>\n<\/ul>\n<p>It added: \u201cIn essence, we must <a href=\"https:\/\/www.pbctoday.co.uk\/news\/bim-news\/g-cloud-public-sector-procurement\/62401\/\" target=\"_blank\" rel=\"noopener noreferrer\">change procurement<\/a> strategies so that the supply chain is involved in the design process from the outset to reduce the incidence of defects.<\/p>\n<p>\u201cFurthermore, firms should be selected on their demonstration of competence rather than on their ability to offer lowest price which often leads to defects. Until the procurement process is altered, these issues will remain in the industry.\u201d<\/p>\n<p>Working in partnership with the <a href=\"https:\/\/secgroup.org.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Specialist Engineering Contractors\u2019 (SEC) Group<\/a>, SELECT has been lobbying MSPs for support for legislation on cash retentions, which it claims are particularly harmful to smaller companies.<\/p>\n<p>SELECT managing director Alan Wilson, added: \u201cMost of the criticisms of the current retention system would be addressed by placing cash retentions in a protected and separate location.<\/p>\n<p>\u201cThis should be accompanied by a fast-track and inexpensive adjudication procedure to resolve disputes over the release of retentions from the scheme.
