{"id":75590,"date":"2020-04-30T10:23:51","date_gmt":"2020-04-30T09:23:51","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=75590"},"modified":"2020-04-30T10:23:51","modified_gmt":"2020-04-30T09:23:51","slug":"rics-conflict-avoidance-pledge","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/rics-conflict-avoidance-pledge\/75590\/","title":{"rendered":"Construction bodies support new conflict avoidance pledge"},"content":{"rendered":"<h2>The <a href=\"https:\/\/www.rics.org\/uk\/\">Royal Institution of Chartered Surveyors<\/a> (RICS) new Conflict Avoidance Pledge will reduce the financial cost of disputes and help projects be delivered on time and in budget<\/h2>\n<p>Under the pledge, clients and contractors commit to implementing conflict avoidance measures in their contracts and on site.<\/p>\n<p>Organisations signing up to the pledge are encouraged to work collaboratively and use early intervention techniques throughout the supply chain to try and resolves issues before they escalate into <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/managing-cash-flow-covid19\/75371\/\" target=\"_blank\" rel=\"noopener noreferrer\">disputes<\/a>.<\/p>\n<p>The Conflict Avoidance Procedure (CAP) helps parties avoid disputes and agree on a settlement by <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/guide-to-mediation\/51224\/\" target=\"_blank\" rel=\"noopener noreferrer\">mediating discussions<\/a>, providing impartial and objective assessments of the issues, recommendations for bases for settlement and providing expert advice.<\/p>\n<p>Several professional bodies in the construction and engineering sectors have signed up to the pledge. These include, for example, the <a href=\"https:\/\/www.ice.org.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Institute of Civil Engineers<\/a>, <a href=\"https:\/\/www.architecture.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Royal Institute of British Architects<\/a>, <a href=\"https:\/\/tfl.gov.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Transport for London<\/a> and <a href=\"https:\/\/www.networkrail.co.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Network Rail<\/a>.<\/p>\n<p>The ambition of this collaboration is to promote greater understanding and use of conflict avoidance techniques, which help contracting parties deal with differences of opinion early and amicably, and avoid costly, slow and potentially damaging litigation.<\/p>\n<h3>A stronger industry<\/h3>\n<p>Andy Mitchell, chair of the <a href=\"https:\/\/www.constructionleadershipcouncil.co.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Construction Leadership Council<\/a>, said: \u201cThe CLC fully endorses the Conflict Avoidance Pledge.
