The confession from two of the largest players in the market \u2013 Associated Lead Mills Ltd and H.J Enthoven Ltd (trading as BLM British Lead) \u2013 follows an investigation by the <a href=\"https:\/\/www.gov.uk\/government\/organisations\/competition-and-markets-authority\" target=\"_blank\" rel=\"noopener noreferrer\">Competition and Markets Authority<\/a> (CMA).<\/p>\n<p>A third company, Calder Industrial Materials Ltd, is also under investigation in relation to one of the arrangements and has not made any admissions.<\/p>\n<p>In its original\u00a0<a href=\"https:\/\/www.gov.uk\/government\/news\/3-major-uk-construction-suppliers-in-provisional-cartel-finding\" target=\"_blank\" rel=\"noopener noreferrer\">provisional findings<\/a>, the CMA alleged that Associated Lead Mills, BLM British Lead and Calder Industrial Materials \u2013 which together account for about 90% of UK rolled lead supplies \u2013 entered into an illegal cartel to share the market amongst themselves.<\/p>\n<p>The CMA has now revised its provisional findings and issued the three firms with a \u2018supplementary statement of objections\u2019, which outlines its updated allegations.<\/p>\n<p>The CMA\u2019s revised provisional view is that there was not a single overall cartel arrangement, but rather four individual arrangements that broke <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/illegal-cartels-construction\/72420\/\" target=\"_blank\" rel=\"noopener noreferrer\">competition law<\/a>.<\/p>\n<h3>The CMA\u2019s revised provisional findings indicate that Associated Lead Mills and BLM British Lead entered into arrangements including:<\/h3>\n<ul>\n<li>Sharing the market, including by arranging not to target certain customers<\/li>\n<li>Colluding on prices<\/li>\n<li>Exchanging commercially sensitive information on prices<\/li>\n<li>Arranging not to supply a new business that risked disrupting the firms\u2019 existing customer relationships and was also a potential competitor in the market.<\/li>\n<\/ul>\n<h3>Admission<\/h3>\n<p>In the light of the CMA\u2019s updated provisional findings, both Associated Lead Mills and BLM British Lead have now admitted to their parts in these arrangements, which took place between October 2015 and March 2017.<\/p>\n<p>The two rolled lead firms have agreed to pay maximum fines totalling more than \u00a311m, although the exact amount will be determined at the end of the CMA\u2019s investigation, if there is a formal final decision that the law has been broken.<\/p>\n<p>With regard to the third firm, Calder Industrial Materials, the CMA has provisionally found that it became involved, at a later stage, in the arrangement with Associated Lead Mills and BLM British Lead not to supply a new business that risked disrupting the firms\u2019 customer relationships and was a potential competitor in the market.<\/p>\n<p>Calder Industrial Materials has made no admission of liability and the CMA\u2019s investigation is continuing.
