Construction union Unite<\/a> has said the latest construction\u00a0site operating procedures are \u201cinadequate\u201d and undermines the use of the correct PPE<\/h2>\n

Unite stated that it will not support the\u00a0latest version of the\u00a0Construction Leadership Council\u2019s site operating procedures<\/a> (SOP)\u00a0unless\u00a0major safety\u00a0failings and potentially illegalities are addressed.<\/p>\n

The construction union has warned that advice relating to\u00a0the use and supply of PPE when a two-metre distance cannot be maintained, and the wrong and potentially illegal information regarding site deliveries, will fail workers.<\/p>\n

The union is particularly concerned that face coverings, possibly homemade and\u00a0not the safer face masks, are being suggested as appropriate and adequate protection\u00a0for workers operating at close quarters to one another.<\/p>\n

Incorrect PPE advice<\/h3>\n

Version 5 of the recently published\u00a0site operating procedures states that when work has to be undertaken where workers are\u00a0less than two metres apart,\u00a0\u201cworkplaces should not encourage the precautionary use of extra PPE to protect against Coronavirus (Covid-19).”<\/p>\n

According to\u00a0Unite, this advice is a corruption of the basic \u2018hierarchy of control\u2019 process\u00a0which should be used on all risk assessments. Where a risk cannot be eliminated by other means, then full and adequate PPE including face masks should be provided.<\/p>\n

Unite says the homemade face coverings are not PPE and \u201cthe CLC must be clear on this in its advice to employers and workers\u201d.<\/p>\n

No consistent advice<\/h3>\n

Additionally, Unite recognises that the CLC’s latest\u00a0advice is at odds\u00a0with the\u00a0major contractors who sit on the CLC who\u00a0are demanding that full PPE is worn when workers are closer than two metres.<\/p>\n

Following a survey by Unite,\u00a0Balfour Beatty<\/a>, Galliford Try<\/a>, Mace<\/a> and Interserve<\/a> have all informed the union they all insist that PPE is worn if a risk assessment identifies that it is required.<\/p>\n

In relation to Covid-safe site deliveries, Unite is concerned that the latest SOP guidance is in breach of\u00a0the instruction in place since\u00a0November 2017, which states that\u00a0all delivery drivers to commercial properties have the right to use the premises\u2019 toilets and welfare facilities.<\/p>\n

Due to the high number of companies that have been failing to adhere to the law, a joint letter<\/a> signed by the Health and Safety Executive<\/a> and the government has been circulated reminding construction companies of their legal requirements.<\/p>\n

Inadequate site operating procedures<\/h3>\n

Unite national officer for construction Jerry Swain, said: \u201cThe latest construction site operating procedures are inadequate. They undermine the use of the correct PPE and Unite cannot support them as they stand.<\/p>\n

\u201cLike many of the major contractors, Unite\u2019s advice to workers is that if you have to work within two metres, full appropriate PPE should be supplied. If it isn\u2019t,\u00a0work should not be undertaken.<\/p>\n

“Face coverings are not PPE and are not an effective alternative.<\/p>\n

“If any Unite member is threatened with disciplinary action for refusing to undertake such work because\u00a0proper\u00a0PPE is not supplied, they will be fully supported by their union.<\/p>\n

\u201cThe information regarding site deliveries is well-meaning but wrong. Drivers<\/a> have a legal right to use welfare facilities and they cannot be refused.<\/p>\n

\u201cIf drivers are refused Unite will report them to the HSE and the\u00a0offenders run the risk of having action taken against them.<\/p>\n

\u201cUnite is fully prepared to name and shame companies that deny drivers the right to use a toilet.\u201d<\/p>\n
