{"id":94857,"date":"2021-06-16T14:00:50","date_gmt":"2021-06-16T13:00:50","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=94857"},"modified":"2021-07-08T14:05:06","modified_gmt":"2021-07-08T13:05:06","slug":"jct-dispute-adjudication-board","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/jct-dispute-adjudication-board\/94857\/","title":{"rendered":"[VIDEO] JCT launches dispute adjudication board documentation 2021"},"content":{"rendered":"<h2><a href=\"https:\/\/www.jctltd.co.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">JCT<\/a> has launched the Dispute Adjudication Board Documentation 2021 (DAB 2021) with an introductory video which reveals how to avoid and resolve disputes<\/h2>\n<div class=\"youtube-embed\" data-video_id=\"YEI3_biB_OU\"><iframe loading=\"lazy\" title=\"JCT Dispute Adjudication Board Documentation 2021 (DAB 2021)\" width=\"696\" height=\"392\" src=\"https:\/\/www.youtube.com\/embed\/YEI3_biB_OU?feature=oembed&#038;enablejsapi=1\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/div>\n<p>An introductory video is now available to <a href=\"corporate.jctltd.co.uk\/dispute-adjudication-board-documentation-2021-dab-2021\" target=\"_blank\" rel=\"noopener noreferrer\">watch via the JCT website<\/a> which explains more about DAB 2021, providing context and background to its production, and explaining the benefits of using a\u00a0Dispute Adjudication Board as a means to avoid and resolve disputes.<\/p>\n<p>The video features Paul Cowan, barrister, 4 New Square and chair of JCT\u2019s Dispute Resolution Group, and Nicholas Gould, partner, Fenwick Elliott LLP, and member of the CIArb\u2019s Policy Sub-committee.<\/p>\n<p>The Chartered Institute of Arbitrators (CIArb) produced a set of Dispute Board Rules in 2014, which form the basis of the DAB rules used in the new <a href=\"https:\/\/www.pbctoday.co.uk\/news\/guides-reviews\/jct-contract-construction\/56366\/\" target=\"_blank\" rel=\"noopener noreferrer\">JCT Documentation<\/a>.<\/p>\n<p>Where the CIArb\u2019s rules were geared towards the international market, JCT rules have been adapted to work domestically on UK projects, and are fully compliant with the statutory adjudication provided in the Housing Grants, Construction and Regeneration Act (Construction Act).<\/p>\n<h3>Best practice in dispute avoidance<\/h3>\n<p>DAB 2021 has been designed for use with the JCT Design and Build Contract (DB) and JCT Major Project Construction Contract (MP) forms, both of which are suitable for large, longer-term projects. The rules are for use between the employer and the contractor under the main contract.<\/p>\n<p>The document pack, containing a model Tripartite Agreement, enabling provisions for DB and MP, guidance notes, and the JCT\/CIArb Rules, provide users with the tools needed to establish and operate a Dispute Adjudication Board under a <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/jct-construction-playbook\/91243\/\" target=\"_blank\" rel=\"noopener noreferrer\">JCT Contract<\/a>.<\/p>\n<p>Dispute Boards (DBs) have been in use on international projects for many years and are regarded as best practice in dispute avoidance.
