{"id":95591,"date":"2021-07-02T08:52:50","date_gmt":"2021-07-02T07:52:50","guid":{"rendered":"https:\/\/www.pbctoday.co.uk\/news\/?p=95591"},"modified":"2021-07-02T08:52:50","modified_gmt":"2021-07-02T07:52:50","slug":"ms-water-fined","status":"publish","type":"post","link":"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/ms-water-fined\/95591\/","title":{"rendered":"Utilities company fined after passer-by dies following fall into excavation site"},"content":{"rendered":"<h2>Utility company, M&amp;S Water (Utilities) Ltd has been fined \u00a3100,000 after a member of the public suffered fatal injuries after falling into an excavation site<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-95593 alignright\" src=\"https:\/\/www.pbctoday.co.uk\/news\/wp-content\/uploads\/2021\/07\/M-and-S-Water-Services-300x200-300x200.png\" alt=\"\" width=\"300\" height=\"200\" \/>Luton Crown Court, sitting at Knight\u2019s Chamber in Peterborough Cathedral, heard how on 28 May 2017 M&amp;S Water Services (Utilities) Ltd was digging on a footpath on Devon Road, Luton to access a stop tap that needed replacing. The stop tap could not be reached by hand and so it was left protected by plastic barriers until a deep dig team could attend a few days later.<\/p>\n<p>Over the bank holiday weekend, a member of the public, Matthew Wilmot, was walking home when he fell into the <a href=\"https:\/\/www.pbctoday.co.uk\/news\/health-safety-news\/construction-excavation-collapse\/93905\/\" target=\"_blank\" rel=\"noopener noreferrer\">excavation site<\/a>. His body was found the next morning.<\/p>\n<h3>HSE investigation<\/h3>\n<p>An investigation by the <a href=\"https:\/\/www.hse.gov.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Health and Safety Executive<\/a> (HSE) found that a suitable and sufficient risk assessment had not been completed.<\/p>\n<p>A suitable <a href=\"https:\/\/www.pbctoday.co.uk\/news\/planning-construction-news\/construction-risk-management\/90885\/\" target=\"_blank\" rel=\"noopener noreferrer\">risk assessment<\/a> would have identified the need for secure fencing, backfilling or covering as the excavation was to be left unattended for five days and there was no easy alternative route for nearby householders.<\/p>\n<p>M&amp;S Water (Utilities) Ltd was found guilty of breaching Section 3(1) of the Health and Safety at Work Act 1974.
